Respondents Petition under Article 226 of the Constitution of India is filed praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ, order or direction more particularly one in nature of Writ of Mandamus declaring the action of the 4*^ Respondent in issuing proceedings vide Rc.No.D/CS/62/2025, Dated 25.08.2025, by Cancelling/Suspending the Fair Price Shop Dealership of the petitioner for Shop No. 1385017,.^Dhone Town, Nandyal District, as illegal, arbitrary and violative of principles of natural justice under Articles 14, 16 and 21 of the Constitution of India and contrary to the provisions of the APSTPDS (Control) Order, 2018and consequently set aside the same. lA NO: 1 OF 2025 Petition under Section 151 CPC is filed praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to suspend the operation of the impugned proceedings of the 4 Respondent in Rc.No.D/CS/62/2025, Dated; 25.08.2025, and direct the respondents to permit the petitioner to continue as the Fair Price Shop Dealer for Shop No. 1385017, Dhone Town, Nandyal District, and to supply essential commodities to her. Pending disposal of WP 24494 of 2025, on the file of the High Court. th The petition coming on for hearing, upon perusing the Petition and the affi^vit filed in support thereof and the earlier order of the High Court dated: ^.09.2025 made herein and upon hearing the arguments of M/s. AYESHA AZMA S Advocate for the Petitioner, GP FOR CIVIL SUPPLIES for the Respondent Nos.1 to 5; Sri G. Raju, Standing Counsel for the Respondent No.6 and the Court made the following. ORDER: “In pursuance of the orders passed by this Court on 12.09.2025, respondent No.4 - Mr.K.P. Narasimhulu, Revenue Divisional Officer, Dhone, appeared before this Court and admitted the mistake committed by him in the said proceedings and stated that the mistake was crept in the orders because of work pressure and he undertook that he will not commit such mistakes in future. On a perusal of the impugned proceedings dated 25.08 2025, it can be observed that the said proceedings were passed after considering the explanation submitted by the petitioner, but however, it creates a doubt as to whether the authorisation of the petitioner was cancelled or suspended as the operative of the portion of the impugned proceedings reads as under: "In view of the above lapses committed by the Temporary FP shop dealer, the authorization of Smt. Dara Lavanya D/0 Dara Prathap Reddy F.P Shop Dealer, F.P Shop No. 1385017 of Dhone Town, Nandyal District is hereby cancelled and Smt Dara Lavanya W/0 Dara Prathap Reddy F.P Shop Dealer. F.P Shop No. 1385017 is hereby Suspended. Therefore, there shall be an interim direction suspending the impugned proceedings dated 25.08.2025 issued by respondent No 4.
