For the Respondents: Mr. Anup Rattan, Advocate General with Mr. Rajan Kahol, Mr. Vishal Panwar and Mr. B.C.Verma, Additional Advocate Generals and Mr. Ravi Chauhan, Deputy Advocate General. ____________________________________________________ Sandeep Sharma, Judge(oral): Petitioner has approached this Court in the instant proceedings, seeking therein direction to the respondents to decide her pending representation dated 09.04.2025 (Annexure P-4), whereby she has prayed for her adjustment at one of the stations of her choice given in the representation on account of adverse family circumstances. 2. While putting appearance on behalf of the respondents, Mr. Rajan Kahol, learned Additional Advocate General, states that though no ground has been made for transfer from the present place 1Whether the reporters of the local papers may be allowed to see the judgment? 2 of posting to the stations given in the representation, but representation, if any, filed and not already decided, shall be decided expeditiously. 3. Having perused the averments contained in the petition, which is duly supported by an affidavit, this Court finds that petitioner at present is working as Staff Nurse at Pandit Jawahar Lal Nehru Government Medical College, Chamba, District Chamba, Himachal Pradesh, but since recently she has lost her husband, she filed representation to the competent authority to transfer her from aforesaid station to Government Medical College, Hamirpur or Zonal Hospital, Hamirpur on account of adverse family circumstances. Since there is none to look after daughter of the petitioner, who at present is studying at Hamirpur, prayer has been made in the instant petition to issue direction to the respondents to consider and decide pending representation of the petitioner sympathetically. 4. Since petitioner has already filed representation, as detailed hereinabove, coupled with the fact that respondent-State has no objection in disposing of the same in terms of the transfer policy, this Court without going into the merits of the case, deems it fit to dispose of the present petition with a direction to the competent authority to consider and decide the pending representation dated 09.04.2025 (Annexure P-4) of the petitioner expeditiously, preferably 3 within a period of two weeks, taking note of transfer policy formulated by the Government of Himachal Pradesh, which admittedly provides for transfer/adjustment of an employee on account of adverse family circumstances. Besides above, transfer policy also provides certain concessions to widows and as such, this Court hopes and trusts that authority concerned, while doing the needful, shall also take note of aforesaid aspect of the matter. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of hearing to the petitioner and pass detailed speaking order thereupon, taking note of the transfer policy.
