Sri M. Vaibhav Raj, learned counsel representing Sri K.S.Murthy, learned senior counsel for the 1st respondent is present. Sri N.Rama Krishna, learned counsel representing Sri Hari Babu Manne, learned counsel for the 2nd respondent is present. No representation for the appellant. In view of the death of Sri Ravi Kumar Tolety, the learned counsel for the appellant reportedly expired, this Court directed issue of notice to the appellant. As such, notice through RPAD was sent by the Registry to the address of the appellant as given in the appeal and the claim petition. The notice was returned un-served with an endorsement ‘want of door number’ after trying to serve the notice on 13.11.2021, 15.11.2021 and 16.11.2021. Therefore, the service of notice is held sufficient. Since the appellant did not take steps to make appearance, the appeal is dismissed for default. There shall be no order as to costs.
