Accordingly, both these Bail Application are being disposed of by a common order. Heard the parties. The petitioners have been made accused in connection with Simariya P.S. Case No. 149 of 2024, corresponding to POCSO Case No.72 of 2024, for the offences registered under Section 137(2), 96, 3(5) of the B.N.S., 2023 and Sections 4, 6 of the POCSO Act, pending in the Court of learned Special Judge (POCSO), Chatra. On 24.08.2024, daughter of the informant went missing. It is alleged that petitioner Saurabh @ Saurav had enticed her to leave her lawful guardianship with intention to marry her. Statement of the victim recorded under Section 183 of the B.N.S.S. earlier called for, has been received. It appears that the victim has stated that she has left her lawful guardianship according to her own wish and she wants to reside with the petitioner Saurabh @ Saurav. As far as the petitioner Tejbeer @ Tejvir is concerned, she has not stated anything about her in statement under Section 183 of the B.N.S.S. -2- This appears to be a case of adolescent love affair between the parties. In view of the submission made above, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of learned Special Judge (POCSO), Chatra, in connection with Simariya P.S. Case No. 149 of 2024, corresponding to POCSO Case No.72 of 2024. (Ambuj Nath, J.) Jay/-
