CORAM : HON’BLE THE CHIEF JUSTICE
HON’BLE MR. JUSTICE RAJESH SHANKAR ----- Amicus Curiae : Mrs. Ritu Kumar, Advocate For the Respondents: Mr. Sahbaj Akhtar, AC to AAG-III -----
Order No.14
Date: 03.11.2025
1. This Court had taken cognizance of an alleged incident of sexual assault on a 45 year old Brazilian national, who was on a motor- bike tour with her husband.
2. The Court has been monitoring this case for a period of one and half year and now on completion of the investigation, the charge- sheet under the relevant provisions of law has been submitted and even the trial has commenced. During the course of trial, half of the witnesses i.e., 16 out of 32 witnesses have already been examined in the evidence and some part of the evidence is to be examined today.
3. We are satisfied with the progress made thus far and, therefore, see no reason to monitor the progress of this case given the fact that the issue is now sub-judice before the competent Court of authority and lest any observation made by this Court may prejudice the case of either of the parties.
