This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 161/2024 registered at Police Station – Marwahi, District – Gaurela-Pendra-Marwahi (C.G.) for the offence punishable under Sections 34(2) and 59(A) of the C.G. Excise Act.

Case of the prosecution, in brief, is that a secret information was received through the informant by the Police of Police Station concerned, and on the basis of the such information a raid was conducted, and thereafter the Police has seized a total of 1420 liters of liquor from the possession of the applicant. Learned counsel appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that the applicant had moved an anticipatory bail application which was rejected by this Court vide
order dated 08.08.2024 passed in MCRCA No. 883/2024, and thereafter, he surrendered on 19.03.2025 and since then he is in jail. It is further submitted that the co-accused persons have been granted bail by this Court vide order dated 06.09.2024 and 05.09.2024 passed in MCRC Nos. 6261/2024 and 4925/2024. It has been further submitted that the applicant is in jail since 19.03.2025, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail. 4. On the other hand, learned State counsel, opposes the bail application and submits that the present case is of the year 2024 and on the date of the incident a huge quantity of liquor i.e. a total of 1420 liters of liquor have been seized from the paplicant, and it is stated that the applicant had moved an anticipatory bail application which was rejected by this Court vide order dated 08.08.2024 passed in MCRCA No. 883/2024, and thereafter the applicant was absconding in the present case and the charge-sheet was filed against him as absconding, thereafter he arrested on 19.03.2025 i.e. after 1 year of incident and the trial is under progress, and there is every likelihood that the applicant will abscond if he would be allowed bail by this Court. As such, the bail application deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and
3 also the fact that the present case is of the year 2024 and on the date of the incident a huge quantity of liquor i.e. a total of 1420 liters of liquor have been seized from the paplicant, and it is stated that the applicant had moved an anticipatory bail application which was rejected by this Court vide order dated 08.08.2024 passed in MCRCA No. 883/2024, and thereafter the applicant was absconding in the present case and the charge-sheet was filed against him as absconding, thereafter he arrested on 19.03.2025 i.e. after 1 year of incident and the trial is under progress, and there is every likelihood that the applicant will abscond if he would be allowed bail by this Court, thus, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7.

Accordingly, this bail application of applicant – Satyanarayan Paikra Alias Sattu involved in Crime No. 161/2024 registered at Police Station – Marwahi, District – Gaurela-Pendra-Marwahi (C.G.) for the offence punishable under Sections 34(2) and 59(A) of the C.G. Excise Act, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
