ORDER:
1. The petitioner is aggrieved by the action of the respondents 2 to 4 in considering the representation of the petitioner dated 26.08.2025, wherein the petitioner requested the 2nd respondent not to grant any permission to respondents 5 to 13.
2. Heard the submissions of the learned counsel for the petitioner and the learned standing counsel for respondents 2 to 4.

The learned counsel for the petitioner submits that the petitioner and respondents 5 to 13 are claiming ownership of separate parcels of land admeasuring 20 cents each in old Sy.No.30/P, new Sy.No.81/3, patta No.17, Thungalam Village, Gajuwaka Mandal, Visakhapatnam District. It is submitted that there is a civil dispute in O.S. No.279 of 2025, wherein an ad-interim injunction was granted in favour of the petitioner. Subsequently, the injunction application (IA) was dismissed. Aggrieved by the said dismissal, the petitioner filed C.M.A. No.3 of 2025, which is pending before the learned XIII Additional District Judge, Gajuwaka.

The learned counsel for the petitioner, after arguing the matter for some time, submits that the petitioner intends to implead the Greater Visakhapatnam Municipal Corporation (GVMC) - 2nd respondent as a party in the pending injunction suit, to prevent GVMC from granting any permission to respondents 5 to 13 relating to the disputed land. The

learned counsel further submits that the representation dated 26.08.2025 filed before the 2nd respondent, is to be considered along with the objections, if any, before granting any permission to respondents 5 to 13.

Considering the submissions, this Court deems it appropriate to dispose of the writ petition, at the stage of admission, directing the 2nd respondent (GVMC) to consider the representation of the petitioner dated 26.08.2025, along with the objections raised, if any, before granting permission to respondents 5 to 13. It is left open to the petitioner to implead the 2nd respondent in the pending civil suit and adjudicate the dispute in accordance with law before the competent civil court. It is further directed that the 2nd respondent shall dispose of the representation of the petitioner, dated 26.08.2025, within a period of eight (08) weeks from the date of receipt of this order.
6. Accordingly, the writ petition is disposed of. No costs.
7. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ___________________ JUSTICE HARINATH.N BV
