Though several contentions have been urged by the petitioner in the present petition, having regard to the undisputed fact that the matter is posted for trial before the learned Magistrate and the petitioner herein himself had undertaken to cross-examine PW1 as long back as on 15.11.2023 and the cross-examination of the PW1 has already commenced by the remaining accused as on today, without expressing any opinion on merits/demerits on the contentions urged in the petition, I deem it appropriate to dispose of this petition reserving liberty in favour of the petitioner to urge all - 3 - NC: 2025:KHC:7657 CRL.P NO.9883 OF 2024 contentions before the Trial Court including the contentions urged in the present petition, which shall be considered by the Trial Court in accordance with law.
