From the written instructions, it is quite evident that a sum of Rs.43,82,855/- has been transferred to the account of the petitioner's mother Pushpa on 29.10.2023. Thereafter, on verifying the amount that is available in her account, it was ascertained that only a sum of Rs.2,38,207/- was available. This amount was freezed. The dispute between the mother and the children with respect to the share in the compensation amount, is a private dispute among the parties which cannot be gone into by this Court. If at all any amount is payable to the petitioner towards her share, it must only be deemed to have been held in Trust by the petitioner's mother. The petitioner has to recover the same from her mother. According to the petitioner, she is entitled for a sum of Rs.8,76,571/- towards her share and what is available in the account of the said Pushpa is only a sum of Rs.2,38,207/-. 5.Taking into consideration the facts and circumstances of the case and considering the claim made by the petitioner, it is not possible for the official respondents to recover the amount from the petitioner's mother and pay it to the petitioner. However, since a sum of Rs.2,38,207/-, is available in the Tamil Nadu Mercantile Bank Limited, Thiruvanmiyur Branch, Chennai-600041 in Account No.158100080200095, which account has been freezed, the petitioner can be permitted to take this amount for the present and recover the balance amount from 4 / 6 https://www.mhc.tn.gov.in/judis her mother and other sharers in the manner known to law. The Branch Manager, Tamil Nadu Mercantile Bank Limited, Thiruvanmiyur Branch, Chennai, shall transfer the sum of Rs.2,38,207/- from Account No.158100080200095, to the Savings Bank Account of the petitioner in Savings Account No. 3201167993 maintained at Indian Bank, Pattabiram Branch. This process shall be completed within a period of two weeks from the date of receipt of copy of the order.
