P.P. 04/ 04.12.2025: Heard learned counsel for the petitioners and learned counsel for the State. 2. The petitioners are apprehending their arrest in connection with Chanho P.S. Case No. 136 of 2025, registered under sections 303(2)/317(5)/ 317(2)/3(5) of BNS, Rules 4, 9, 11 of the Jharkhand Minerals Prevention of Mining Transportation and Storage Rule, 2017, Rule, 4, 54 of the Jharkhand Minor Minerals Concessions Rule, 2004, pending in the Court of learned Judicial Magistrate, Ranchi. 3. Learned counsel for the petitioners submits that petitioner no.1 is the owner and petitioner no.2 is driver of the truck in question and allegations are made that 50 cft sand was loaded on the said truck. He further submits that petitioners have got no criminal antecedent which is disclosed in para 5 of the petition. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that illegally the sand was loaded on the said truck. 5. Considering that petitioner no.1 is the owner and petitioner no.2 is driver of the truck in question, they have got no criminal antecedent which is disclosed in para 5 of the petition and quantity of sand is only 50 cft, ( 2025:JHHC:36352 ) I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ist Class, Ranchi, in connection with Chanho P.S.
