The Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the Petitioners/accused Nos.1 to 4 to grant anticipatory bail in connection with Crime No.297 of 2024 of EIuru Ill Town Police Station. A case has been registered against the petitioners/accused Nos.1 to 4 for the offences punishable under Sections 329(4), 318(4), 308(2), 308(5), 351(2), 74,111 (2) read with 3(5) of B.N.S.. 3. Case of the prosecution js that, on 06.10.2024, the de-facto complainant lodged a report stating that he borrowed money as a loan for faml-ly necessities from accused No. 1 on 16.03.2023. Despite repaying more than the borrowed amount after six months, the accused continued to demand additional payments. Accused forcibly obtained his signatures on empty cheques, promissory notes, and white papers. Furthermore, the accused, With the assistance of A2, A3, and A4, forcibly took away household items, including a Television, Refrigerator and his wife'S gold ear studs. The de-facto complainant also alleged that the accused threatened to file a complaint in the court if, they failed to repay the amounts, 4. Heard. Perused the record. 5, A perusal of the record goes to show that there are Certain civil litigations pending between the defacto complainant and the accused. The alleged offences said to have been taken Place in the year 2023. Therefore, in order to settle civil litigation that has been pending, this case appears to have been registered at a belated stage on o6.10.2024. After lapse of a year, the Present complaint has been filed, as against the petitioners herein. It appears that there is no explanation with regard to the delay caused. c€froLi- 3 6. ln view of th-e,,said reasons, this court is inclined to grant anticipatory bail to the petitI'OnerS/accused Nos.1 to 4. 7. Accordingly, in the event of their arrest, petitioners/accused Nos.1 to 4 shall be released on bail on executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) each, with two, sureties for the like sum each to the satisfaction of the arresting police officials and also on condition that the petitioners shall make themselves available for l'nvestigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. The petitioners shall appear before the station House Officer, Eluru lll Town Poilce Station, once in a week i.e. on every sunday between 10.00 a.m. and 05.00 p.m., till filing of the charge sheet.
