Neutral Citation No. - 2025:AHC:50617-DB Court No. - 29 Case :- WRIT - C No. - 9450 of 2025 Petitioner :- Shri Balaji Developers Agency Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Krishna Dutt Awasthi Counsel for Respondent :- Ashish Mishra,C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Petitioner contends that it has supplied a vehicle to the respondent pursuant to a contract awarded in its favour on the Gem Portal and the dues payable have not been released. According to petitioner the vehicle was provided for a period of three years but the payment in terms of contract amounting to Rs.5,24,300/- is still withheld. Sri Rahul Srivastava, appearing for the respondents states that some time be given to the respondents to examine the matter. In the facts of the case, we are of the view that the grievance raised by the petitioner can always be examined by the second respondent, at the first instance. In that view of the matter, this writ petition stands disposed of with liberty to the petitioner to approach the second respondent, who would examine the claim of petitioner and would pass an appropriate order, within a period of six weeks from the date of presentation of a certified copy of this order. The amount which is found due and payable to the petitioner would be released without any further loss of time. It is made clear that we have not adjudicated the claim of petitioner, on merits, and all issues on facts are left open to be considered by the authority concerned in terms of contract, at the first instance.
