Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ, order or direction more particularly in the nature of writ of mandamus declaring the action of the 3rd respondent in trying to evict us from the shop bearing Door No. 7-3-18/11-2, T.S.No.360. Assessment No.1085010664, situated near etition Ramalakshmana junction, Srikakulam without following due process of law as illegal, arbitrary and is un authorized by law and consequently direct the respondents 3 not to call us to the II Town Police Station, Srikakulam and insist us at the instance of respondents 4 and 5 to vacate the shop and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 3rd respondent not to call us to the II Town Police Station, Srikakulam and insist us to vacate the shop bearing No.7-3-18/11-2 without following due process of law pending disposal of the Writ Petition and pass Counsel for the Petitioner:

This Writ Petition is filed under Article 226 of Constitution of India with the following prayer:
“…..to issue an appropriate writ, order or direction more particularly in the nature of writ of mandamus declaring the action of the 3rd respondent in trying to evict us from the shop bearing Door No.7-3-18/11-2, T.S.No.360, Assesment.No.1085010664, situated near Ramakrishna junction, Srikakulam without following due process of law as illegal, arbitrary and is un authorized by law and consequently direct the respondentNo.3 not to call us to the II Town Police Station, Srikakulam and insist us at the instance of respondents 4 and 5 to vacate the shop and pass…”

When the matter is taken up for hearing, Sri V.Farook, learned Assistant Government Pleader would submit that, upon verification, it has been found that the police authorities have not received any complaint from the petitioner in connection with the subject matter of the writ petition and the Writ Petition may be closed. 4. Recording the same, this Writ Petition is disposed of. However, the petitioner is at liberty to recourse his remedies according to law before the appropriate forum.
