GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the respondents 3 and 4 in illegally threatening the petitioner to vacate the property ie., two storied house building (with pent house) bearing D.No.2-23-13 (New) situated in an extent of 302 in 1/3 sq. yards in R.S.No.391 situated within Tadepalligudem Municipality at the active instance of the 6th respondent and ignoring the pendency of the WP NO. 14438/2024 before the Hon'ble High court of AP, PLC No.105/2024 on the file of XI Addl.District Judge court, Tadepalligudem and OS NO.51/2024 and OS No.59/2024 on the file of Senior Civil Judge court, Tadepalligudem filed by the respondents 5 and 6 without any manner of right saying that they got heavy pressure from their higher authorities for vacating the petitioners from the said property and attempted to break open the lock of the property by sending some un-known persons etc., without any manner of right and further threatening to foist false criminal cases against the petitioners as illegal, arbitrary, discriminatory, unconstitutional and violative of principles of natural justice and consequently direct the respondent No.3 and 4 not to interfere with the civil rights of the petitioner and his property in any manner.” 2. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, the matter is purely civil in nature, they have not received any petition regarding the issues, they did not call the Petitioners to the Police Station and did not threaten them. 3. None appeared for the Petitioners. 3 4. Considering the submissions made, the Writ Petition is disposed of giving liberty to the Petitioners to work out their remedies before appropriate forum in accordance with law. There shall be no order as to costs.
