Dr. YLR, J CrI.P.No.9464 of 2025 Dated 19.09.2O25 The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity {the BNSS]) by the petitioner/Accused No.3 for granting of pre-arrest bail in connection with Crime No.221 of 2025 of Prohibition & Excise Station, Rajamahendravaram, East Godavari D'lstrict, registered for the alleged offence punishable under Section 7-B read with 8-B. of the Andhra pradesh prohibition Act,1995. 2. The case of the prosecution is that on 04.09.2025 at about 10.15 a.m., acting on the instructions of the Director, Prohibition & Excise, Mangalagiri, and on reliable information regarding the sale of I.D. liquor near the Cycle Stand, Godavari Railway Station, Rajamahendravaram Urban, the S.T.F. Inspector, along with staff, proceeded to the spot and informed the VRO, Ward No,33, Rajahmundry, Smt. Nakka.Venkata Lakshmi (LW1). On reaching the spot, the team noticed a person lt collecting money from the public and supplying liquor in white plastic bottles. On seeing the staff, several persons fled, but the seller was apprehended, and on questioning, he admitted to selling I.D. liquor. On search, eleven (ll) plastic bottles of 250 ml each were recovered from ¢ ----\

In total, fI-fteen (15) bottles conta[-njng 3.75 II-terS of I.D. liquor were seized. The RC found in the vehicle revealed it to be a Honda ActI|Va registered in th9 name of Koradl| Durga Rao of RaJahmundry Rural. The apprehended person disclosed his I'dentI'ty and further admitted that the liquor was being supplied by one yandamurj Raju @ Rebel Raju of Kotagummam centre, RaJ'ahmundry Urban (A2), who dell'vers about 100 bottles (25n ml each) of I D liquor to hl'm every day.Hence, the FIR. 3. Srl' Kadl-yam Neelakanteswara Rao, the learned counsel for the petitioner, contends that the petI'tiOner I-S a lady and she I-S innocent of the alleged offence and she has been falsely jmpljcated by the poll-Ce. The pe{jtioner undertakes {o str[ctly adhere to any condl'tions that may be imposed by this court. ln II|ght of the foregol|ng submI-SSI'OnS, learned counsel prays that the present petition be allowed jn the interest of justice. Per confra, Ms.P.Akhila Najdu, the learned Assistant publI|C prosecutor, vehemently opposed the grant of pre-arrest ba" to the petitioner, submitting that the investigation is s{I'll unclerway and several material witrfesses remain to be examined. lt is contencled that if the `-.. \ \` Dr. YLR, I a Crl.P.No.9464 of 2025 Dc,ted 19.O9.2025 petitioner is released on pre-arrest hail, there is a strong likelihood that she may abscond, thereby hampering the ongoing investigation and evading the process of law, and urged to dismiss the petition. 5. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 6. As perthe mediator's report dated 04.09.2025, the Prohibition and Excise Inspector, Rajamahendravaram, recorded that the accused made a confessional statement regarding possession of 3.75 liters of I.D. liquor. Based on the confession of Accused No.1, the petitioner has been arraigned as Accused No.3. The petitioner is stated to be only a supplier of the said liquor.
The petitioner is a lady. The learned Assistant Public Prosecutor submits that there are no adverse antecedents against th'e` petitioner/Accused No.3. 7. Considering the facts and cl'rcumstances of the case, the gravity and nature of the allegations leveled against the petitioner, the alleged role played by him in this case, this Court deems it fit to grant pre-arrest / bail to the petitioner with the following condit'lons:

In the event of her arrest] the petitioner/Accused No.3 shall be enlarged on bail subject {o she executing a Personal bond for a Sum Of Rs.10,OOO/-(Rupees Ten Thousand only) with two sureties for the like sum each to the satisfaction of the arresting police officials; ii. The petitioner/Accused No.3 shall make herself available for investigation as and when required; iii. The petitioner/Accused No.3 shall notcause any threat, inducement or promise to the prosecution witnesses; iv. The petitioner/Accused No.3 shall appear beforethe Station House Officer concerned once in a week i.e., on every Saturday between lO.00 a.m. and 5.OO p.m., till filing of the charge sheet. v. The petitioner/Accused No.3 shall not leave the limits of the District without the express permission from the Station House Officer concerned. .
