The Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the Petitioner/accused No.2 to grant anticipatory bail in connection with Crime No.176 of 2024 of Musunuru Police Station. Eluru District. 2. A case has been registered against the petitioner/accused No.2 and others for the offences punishable under sections 318(4), 308(2), 308(5), 351 (2), 111 (2) read with 3(5) of B.N.S. €1-i \_-3 t -±=--iS 2 3. Case of the prosecution is that, on o7.10.2024, the de-facto complainant lodged a report stating that he borrowed money as a loan for family necessities from accused No.1. Despite repaying more than the borrowed amount, the accused continued to demand additional payments. Accused forcl'bly obtained his signatures on empty cheques, promissory notes, and white papers. Furthermore, the accused, with the assistance of the petitioner, A3, and A4, forcibly took away household items and a Motorcycle bearing No.AP16DE9994. The de-facto complainant also alleged that the accused threatened to file a complaint in the court if, they failed to repay the amounts. 4. Heard. Perused the record. 5. A perusal of the record goes to show that there are certain civil litigations pending between the defacto complainant and the accused. Therefore, in order to settle civil litigation that has been pending, thl-s case appears to have been registered at a belated stage on 07.10.2024. After lapse of one year, the present complaint has been filed, as against the petitioner herein. It appears that there is no explanation with regard to the delay caused. 6. ln view of the said reasons, this court is inclined to grant anticipatory bail to the petitioner/accused No.2. 7. Accordingly, in the event of his arrest, petitioner/accused Nos.2 shall be released on bail on executing a personal bond for a \.----,..` 3 ~/ sum of Rs.10,000/- (Rupees ten thousand only) each, with two sureties for the like sum each to the satisfaction of the arresting POIice officials and also on condition that the petitioner shall make themselves available for investigation as and when required and that he shall not cause any threat, inducement or promise to the Prosecution Witnesses. The petitioner shall appear before the station House Officer, Musunuru poilce Station, once in a week I-.e. on every sunday between 10.00 a.m. and o5.00 p.m., till filing of the charge sheet.
