The Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner/accused No.1 to grant anticipatory bail in connection with Crime No.243 of 2024 of T. Narasapuram Police Station, Eluru District. -. \.-I--`o \ --- 2 2. A case has been registered against the petitioner/accused No.1 and others for the offences punI-Shable under Sections 318(4), 308(5), 351(2),111 (2) (b) read with 3(5) of B.N.S. 3. Case of the prosecution is that, on o6.10.2024, the de-facto comPIainant lodged a report statI®ng that he borrowed money as a loan for family necessities from accused No.1. Despite repaying more than the borrowed amount after six months, the accused continued to demand additional payments. Accused forcibly obtal'ned his signatures on empty cheques, promissory notes, and white papers. Furthermore, the accused forcibly took away his Motorcycle bearing No.APO7AU8492. The de-facto complainant also alleged that the accused threatened to file a complaint in the court if, they failed to repay the amounts. 4. Heard. Perused the record. 5. A perusal of the record goes to show that there are certain civil Iitigations pending between the defacto complainant and the accused. The alleged offences said to have been taken place in the year 2023. Therefore, in order to settle civil litigation that has been Pendl-ng, this case appears to have been registered at a belated stage on 06.10.2024. After lapse of a year, the present complaint has been filed, as against the petitioners herein. lt appears that there is no explanation with regard to the delay caused. `.ii= iii= rs-=*fi- 3 6. ln view of the Said reasons, th'lS Court is inclined tO grant anticipatory bail to the petitioner/accused No.1. 7. Accordingly, in the event Of his arrest, Petitioner/accused No.1 shall be released on bail on executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand Only) each, W'Ith two Sureties for the like sum each to the satisfaction of the arresting police officials and also on condition that the petitioner shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecut-Ion witnesses. The petit'IOner Shall appear before the Station House Officer, T. Narasapuram Poilce Station, once in a week i.e. On every Sunday between 10.00 a.m. and 05.00 p.m., till filing of the Charge Sheet. Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, Pending, Shall stand closed.
