The instant Cr.M.P. has been filed under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for extension of period of surrender passed in A.B.A. No. 6438 of 2024 vide order dated 16.10.2024.
2. Mrs. Priyanka Boby, learned counsel appeared on behalf of the petitioners and submitted that petitioners could not appeared before court concerned and furnish bail bond within stipulated time given by this Court vide order dated 16.10.2024 passed in A.B.A. No. 6438 of 2024, as the above said fact has not been communicated to petitioners by the learned counsel. On this premise, prayer for extension of time has been made.
3. Such submission has been made in presence of Mr. Shailesh Kr. Sinha, learned Additional Public Prosecutor appearing for the State.
4. This Court is not fully convinced with the plea taken on behalf of the petitioners. However, for ends of justice, this Court is inclined to extend the period of surrender for seven working days. According, petitioners are directed to surrender before the court concerned within seven working days from today and remaining part of the order dated 16.10.2024 passed in A.B.A. No. 6438 of 2024 shall remain intact.
5. Let this order be treated as a part and parcel of the order dated 16.10.2024 passed in A.B.A. No. 6438 of 2024.
6. Accordingly, Cr.M.P. No. 635 of 2025 is disposed of.
