HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 19028/2023 Shanti Katta W/o Shri Suresh Chand Katta, Aged About 73 Years, R/o Plot No. D-85 B, Meera Marg Banipark, Jaipur, Rajasthan Through Legal Heir Rakesh Katta S/o Suresh Chand Katta. ----Petitioner Versus 1. Shri Raghunandan Singh Shekhawat S/o Lt. Shri Rajendra Singh Shekhawat, Resident Of Plot No. D-85 B, Meera Marg, Banipark, Jaipur, Rajasthan 2. Shrimati Meenu Kanwar W/o Shri Raghunandan Singh Shekhawat, Resident Of Plot No. D-85 B, Meera Marg, Banipark, Jaipur, Rajasthan ----Respondents For Petitioner(s) : Mr. Kapil Bardhar For Respondent(s) : JUSTICE ANOOP KUMAR DHAND Order 08/07/2025 1. A limited prayer has been made in this petition for issuing a direction to the Rent Tribunal, Jaipur Metropolitan-II to decide the rent eviction application expeditiously within a time frame. 2. Counsel for the petitioner submits that an application under Section 9 of the Rajasthan Rent Control Act, 2001 (for short, ‘the Act of 2001’) has been submitted by the petitioner against the respondents for his eviction before the Tribunal in the year 2022 and the same is still lying pending for its adjudication. Counsel for the petitioner submits that for one reason or another the case has been deferred and till date the evidence of the petitioner has not been recorded. Counsel submits that the petitioner is in advanced (2 of 2) [CW-19028/2023] age of 75 years, so appropriate direction be issued to the Tribunal to decide the pending application expeditiously. 3. Considering the arguments raised by counsel for the petitioner and looking to the fact that the eviction application submitted by the petitioner is pending since 2022 and looking to the advanced age of the petitioner i.e. 75 years, this Court deems it just and proper to dispose of the instant writ petition with an expectation from the Tribunal to make all possible endeavours to decide the pending application expeditiously as early as possible, preferably within a period of eighteen months from the date of receipt of the certified copy of this order. 4. All pending application(s), if any, also stand disposed of. (ANOOP KUMAR DHAND),J Ashu/39
