ORDER:
The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:-
“….to issue an appropriate Writ, Order or direction under Article 226 of constitution of India more particularly one in the nature of Writ of Mandamus declaring the inaction of the Respondents in not reinstating the petitioner as the fair price shop by revoking the medical leave considering the representation, dated 18.08.2025 submitted by the petitioner as arbitrary and illegal contrary to the provisions of the Andhra Pradesh State Targeted Public Distribution System (Control) Orders, 2018 and contrary to the well-established legal principles apart from being violative of the fundamental and Constitutional rights guaranteed to me under Articles 14, 19, 21 and 300-A of the Constitution of India and consequently direct the Respondents to consider the Representation and revoke the medical leave and continue me as the fair price shop dealer…”
2. The petitioner was appointed as a temporary fair price shop dealer for shop No.1183009, situated in Rayachoty Village and Mandal, Annamayya District, in the year 2008, vide proceedings in Ref.No.A/1403/2008, dated
08.09.2008. The said authorization has been extended from time to time. Since the date of the petitioner’s appointment, the petitioner has been distributing essential commodities to the cardholders without there being any complaint from any corner. 3. While the matter being so, on 16.04.2025, the petitioner submitted a representation to the 4th respondent requesting to grant medical leave for a

period of three months. Thereafter, the petitioner was on medical leave for the said period, and after completion of the medical leave, the petitioner submitted a representation to the 3rd respondent on 18.08.2025 requesting to reinstate her as a fair price shop dealer. As no orders have been passed on the said representation, the present writ petition is filed. 4. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Civil Supplies representing the respondents. 5.
In view of the fact that the representation dated 18.08.2025 made by the petitioner is pending before the 3rd respondent, instead of going into the merits of the case, the Writ Petition is disposed of directing the 3rd respondent to pass appropriate orders on the representation dated 18.08.2025, within a period of two (02) months from the date of receipt of copy of this order.
