The petitioner has not challenged any specific order but is aggrieved by such inaction, and also by the failure of respondent No. 2 to act upon and comply with the directions passed by the Commissioner, Raipur Division, vide order dated 17.09.2025. The petitioner has prayed for following relief(s):- “10.1 That the Hon'ble Court may graciously be pleased to call the records pertaining to the petitioner case. 102 That the Hon'ble court may be pleased to direct the respondent no 2 to consider and decide petitioner grievance and to act on the direction order od 17/09/2025 (Annexure P/1) passed by the Commissioner, Raipur Vision in revenue case no 202407970100001/323 B-121 2023-2024 and pass an order within 30 days, in the interest of justice. 10.3. That any other relief which this Hon'ble court may deem fit and just may also kindly be granted to the petitioner, in interest of justice.” 2 Learned counsel for the petitioner submits that the Commissioner, Raipur Division, vide order dated 17.09.2025 (Annexure P/1), has remanded the matter back to the Collector, Raipur for deciding the 3 matter afresh by passing a speaking and reasoned order. However, it is submitted that despite the petitioner approaching the office of the Collector along with the aforesaid order, no action has been taken till date and the proceedings have not been initiated by the concerned authority. It is further submitted that the petitioner is seeking a direction to respondent No. 2/Collector, Raipur to consider and comply with the order passed by the Commissioner, Raipur Division dated 17.09.2025 and to initiate and conclude the proceedings by passing a speaking order after affording due opportunity of hearing to all concerned parties. 3 Learned counsel for the State submits that since the matter has already been remanded by the Commissioner, the authorities are bound to comply with the said order in accordance with law. It is further submitted that the interveners, if any, may approach the concerned Collector by filing appropriate application in accordance with law. 4 Having heard learned counsel for the parties and having considered the material available on record, this Court finds that the Collector, Raipur has not taken any effective steps for compliance of the order dated 17.09.2025 passed by the Commissioner, Raipur Division. Accordingly, respondent No.2/Collector, Raipur is directed to take up the matter and decide the same in compliance of the aforesaid order in an expeditious manner, preferably within a period of 60 days from the date of 4 receipt of certified copy of this order. The Collector shall initiate the proceedings forthwith and ensure that the matter is decided by passing a reasoned and speaking order after granting due opportunity of hearing to all concerned parties. 5 With the aforesaid observations and directions, the writ petition stands disposed of.
