Heard Mr. Syed Ali Imam, learned counsel for the applicant, Mr. Bhupendra Pal Singh, learned AGA for the State and perused the record. 2. This Court has rejected the first bail application of the applicant on 18.04.2024 assigning following reasons:- "(a) The applicant is a repeated offender and there is long criminal history of 64 cases in his credit. It is declared that some of criminal cases are decided, however, outcome thereof are not recorded; (b) The allegations against applicant are serious that he is leader of an extortion racket and since deceased has failed to fulfill demand of money, therefore, he was eliminated as well as Court takes note of nature of injuries caused to deceased". 3. In pursuance of an order passed by this Court, learned Trial Court has submitted a status report that out of the 19 proposed witnesses, 4 witnesses have been examined and statement of PW-5 is under way. 4. Mr. Syed Ali Imam, learned counsel for the applicant submits that the applicant is in Jail since 02.03.2022, i.e., just more than three years, however, he has not able to dispute about long criminal history. 5. In aforesaid circumstances, trial is proceeding and considering criminal history of the applicant and likelihood of extending threat to remaining witnesses still exists, therefore, present bail application is rejected.
