1. The accused/applicant has moved this first bail application under Section 483 of BNSS, 2023 for releasing him on regular bail during trial in connection with Crime No. 95/2025 registered at Police Station – Jaijaipur, District – Sakti (C.G.) for the offence punishable under Section 76, 126(2) of BNS, 2023 and Section 8, 12 of POCSO Act. The case of the prosecution is that, that the complainant lodged a report at Police Station Jaijaipur, District Sakti, alleging that on 02.05.2025, at around 1:30 pm, when the victim, a minor girl, was returning home from a provision store after purchasing a Pepsi, the applicant allegedly dragged her into the abandoned house of Rajesh Lahre and committed molestation. Based on this report, an offence was registered against the applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the case. It is further submitted that the applicant neither known to the victim girl nor he tried to commit any kind of wrong act with her. The applicant has no criminal antecedent and has been in jail since
07.05.2025. There is no likelihood of his case being decided in the near future, therefore, the present applicant may be released on bail. 4. On the other hand, the learned counsel for the State opposed the bail application, submitting that the victim was about 13 years old at the time of the incident and had supported the prosecution's case in her statement under Section 183 of the BNSS. Since the trial has not yet commenced, the applicant may not be released on bail. 5. Today, victim along with her mother and father appeared in person and raised her objection in granting bail to the applicant. 3

I have heard learned counsel for the parties and perused the case diary. 7. Considering the entire facts and circumstances of the case, particularly looking to the material available on record and the evidence against the applicant, further considering the fact that trial has not yet commenced, therefore, at this stage, I am not inclined to release the applicant on bail. 8. Accordingly, the bail application filed under Section 483 of BNSS, 2023 is rejected. 9.
