UWPMS/671/2025 UHon’ble Manoj Kumar Tiwari, J. Mr. Dushyant Mainali, Advocate for the petitioner.
2. Petitioner filed a Civil Suit. He also filed a Temporary Injunction Application in the said Suit. The said Application was rejected by learned trial Court. Miscellaneous Appeal filed by petitioner was dismissed by learned Appellate Court. Thus, feeling aggrieved, petitioner has approached this Court.
3. Heard learned counsel for the petitioner and perused the record.
4. Both the learned Courts below has returned a finding that petitioner could not make out prima facie case for grant of temporary injunction.
5. Injunction is a discretionary relief. Since both the Courts below have taken a concurrent view that petitioner has not made out case for grant of interim relief, therefore, this Court is not inclined to interfere with the discretionary order passed by learned Courts below.
6. The writ petition thus fails and is dismissed.
7. No order as to costs.
