NC: 2025:KHC-D:1697 CRL.P No. 100372 of 2025
ORAL ORDER
1. Respondent No.2 lodged a First Information Report (FIR) alleging that the petitioner had criminally trespassed onto his land, abused him, and cut down standing trees on his property. Upon investigation, the police submitted a ‘B’ report. Aggrieved by the same, Respondent No.2 filed a protest petition.
2. The petitioner’s grievance is that, despite being exonerated by the police, the trial Court has not passed any order on the protest petition filed by Respondent No.2 since August
2024. The pendency of the protest petition has prevented the petitioner from removing the felled trees, thereby causing monetary loss.
3. In view of the above, the following order is passed:
ORDER
(i) The petition is disposed of with a direction to the Principal JMFC, Kumta, to dispose of the protest petition filed by Respondent No.2 in Crime No.84/2022, registered at Kumta Police Station, within a period of four weeks from the date of receipt of this
order.
