In fact, the occurrence had taken place on 05th August 2023, whereas the FIR was registered on 08th August 2023, i.e., after a delay of 03 days and the petitioner was assigned a false role by the complainant in the FIR due to some old enmity. Learned counsel further contends that it AMIT RANA 2025.08.22 10:44 I attest to the accuracy and authenticity of this judgement/order CRM M-13502 of 2025 (O&M) 3 has been alleged that the petitioner was carrying an ice pick and caused injuries on the back of the injured, whereas, the medical evidence clearly proved that the injuries were not caused with an ice pick. The petitioner was arrested on 12th October 2023 and is in custody for the last about 01 year and 10 months. He further contends that the prosecution has been able to examine only 03 witnesses out of 16 witnesses so far. The conclusion of the trial may take quite a long time. He refers to the order dated 17.07.2024 (Annexure P-5) passed by this Court in CRM-M-29701 of 2024, whereby, the concession of bail has been allowed to Sourabh, co-accused. 4. On the other hand, learned State counsel has vehemently opposed the prayer made by the learned counsel for the petitioner on the ground that there are serious allegations against the petitioner and the petitioner is not entitled for the concession of regular bail. 5. I have heard learned counsel for the parties and perused the record. 6. In the present case, the petitioner is stated to be in custody for the last more than 01 year and 10 months. Even, the injured has already been discharged in the present case and the conclusion of the trial may take quite a long time. 7. In view of the above, without commenting any further on the merits, the present petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the AMIT RANA 2025.08.22 10:44 I attest to the accuracy and authenticity of this judgement/order CRM M-13502 of 2025 (O&M) 4 satisfaction of the learned trial Court/Duty Magistrate/CJM concerned. 21.08.2025 (N.S.SHEKHAWAT) amit rana JUDGE Whether reasoned/speaking : Yes/No Whether reportable : Yes/No AMIT RANA 2025.08.22 10:44 I attest to the accuracy and authenticity of this judgement/order
