This writ petition has been filed by the petitioner praying for following reliefs:- "i. Issue a writ, order or direction in the nature of mandamus directing the respondents to ensure arrears of salary during suspension period of three times which had been lapsed after 60 days in May, 2015 to August, 2015 and July, 2017 to September, 2017 and also bonus be paid of the aforesaid year. ii. Issue a writ, order or direction in the nature of mandamus directing the respondent No.3 to grant second A.C.P. which is accrued in his favour in 2021. iii. Issue a writ order or direction in the nature of Mandamus directing the respondents to declared the suspension order dated 08.12.2024 passed by the Committee of Management has become in operative and passed the arrears of salary and future salary to the petitioner as and when falls due." It is submitted by learned counsel for the petitioner that the claim of the petitioner for payment of salary during suspension period, which has lapsed and the ACP is pending consideration before the District Inspector of Schools. In this respect, the petitioner has made a representation dated 10.2.2025. However, till date the same has not been decided. Sri Atul Srivastava, learned counsel for the respondent no.4 submits that the petitioner is creating indiscipline and nuisance in the institution, as a result of the same, the petitioner has been placed under suspension on 14.12.2024. The District Inspector of Schools has recorded a categorical finding in the order dated 29.3.2025 that the suspension papers have not been received, which learned counsel for the Committee of Management disputes. In view of the aforesaid, it is directed that the District Inspector of Schools shall accord consideration to the representation of the petitioner as well as the claim of the Committee of Management that the suspension papers have been submitted in the office of District Inspector of Schools on 12.12.2024 within a period of one month from the date of filing of certified copy of this order after hearing the rival parties.
