Heard the parties.
The petitioner has been made accused in connection with Simariya P.S. Case No. 81 of 2025, corresponding to POCSO Case No.65 of 2025, for the offence under Sections 137(2) & 96 of B.N.S. and Section 8 of POCSO Act, pending in the court of learned Additional Sessions Judge-cum-Special Judge (POCSO), Chatra.
Petitioner is alleged to have enticed away the daughter of the informant to leave her lawful guardianship with an intention to marry her.
The statement of the victim has been recorded during the course of investigation, in which, she has stated that she was having affairs with the petitioner and she has left her lawful guardianship according to her own wish. The age of the victim has been assessed to be 17 and half years.
This appears to be a case of adolescent love affairs between the parties.
In view of the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge- cum-Special Judge (POCSO), Chatra, in connection with Simariya P.S. Case No. 81 of 2025, corresponding to POCSO Case No.65 of 2025.
