Sri Shailesh Pandey, learned counsel for petitioner fairly submits that there is a legal impediment to consider the prayer of petitioner since her husband has died after the age of 60 years, therefore, she may not be entitled for death cum retirement gratuity and prays that this writ petition may be disposed of. Sri Bipin Bihari Pandey, learned counsel for BSA has also placed the same submission.
