Order 22/05/2025
1. The instant bail application has been filed under Section 483 B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.407/2024 registered at Police Station Newai, District Tonk for the offence under Section 137(2) of B.N.S. During the course of investigation, charge-sheet has been filed for the offences under Sections 137(2), 123, 103(1) and 64(1) of B.N.S. and Sections 3 & 4 of POCSO Act.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the accused-petitioner himself remained hospitalized for consuming poison on 25.08.2024. He further submits that charge-sheet has already been filed in this matter. The accused-petitioner is in custody since 19.10.2024 and the trial/investigation of the case may take considerable time,
[2025:RJ-JP:21580] (2 of 2) [CRLMB-13512/2024] therefore, the bail application of the accused-petitioner may be allowed. Further custody of the petitioner would not serve any fruitful purpose.
3. Learned Public Prosecutor and learned counsel for the complainant vehemently oppose the bail application.
4. Heard learned counsel for both the parties and perused the material available on record.
5. Considering the fact that the accused-petitioner is in custody since 19.10.2024 and charge-sheet has already been filed in this matter and also considering the fact that the accused-petitioner himself remained hospitalized for consuming poison and the trial/investigation of the case may take considerable time, thus, without commenting anything on the merits/demerits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioner Vishnu S/o Prahlad, in connection with FIR No.407/2024 registered at Police Station Newai, District Tonk, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
