Counsel for the accused-applicant submits that the accused- applicant has falsely been implicated in the present case, and hearing/disposal of appeal is likely to take long time. Therefore, the sentence given to the accused-applicant be suspended during the pendency of the appeal. 3. Learned Government Advocate-cum-Additional Advocate General opposed the present application for suspension of [2025:RJ-JP:10994-DB] (2 of 2) [SOSA-1989/2024] sentence and submitted that according to statement of victim-PW6, the accused-applicant has inserted his finger in her private part and as per statement of Doctor-PW9, hymen of the victim was found ruptured and there were injuries on her private part. 4. Considering the facts and circumstances of the present case as well as statement of victim-PW6 and Doctor-PW9, no case is made out to suspend the sentence given to the present accused- applicant. 5. In that view of the matter, this D.B. Criminal Miscellaneous Second Suspension Of Sentence Application No. 1989/2024 preferred in connection with D. B. Criminal Appeal No.179/2020 stands dismissed.
