NO.10677/E4.B/2024, dt- 27-08-2024 is arbitrary, illegal and violative of Fundamental Rights guaranteed under Articles 14, 16 and 21 of the Constitution of India and consequently direct the Respondents to consider the Petitioner case for re-fixing the seniority at appropriate place in the Head Nurses Zone-Ill, forthwith and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the respondents particularly Respondent No.3 to consider and re-fix the Petitioner Seniority as per the proceedings bearing R.C. ORDER :
This writ petition is filed questioning the inaction of the 3rd Respondent in re-fixing her seniority as Head Nurse in Zone-III as per proceedings R.C.No.10677/E4.B/2024 dated 27.08.2024 issued by Respondent No.2 as illegal and arbitrary.
2. The case of the Petitioner is that she was appointed as Nurse on 03.01.2006 and was promoted as Head Nurse on 11.02.2011. While so, the 3rd respondent vide seniority list dated 02.06.2018 figured the Petitioner at Sl.No.141, which is lower than her juniors as she supposed to be listed at Sl.No.54. Aggrieved by the same, the Petitioner made a representation dated 08.07.2024. Considering the representation, 2nd Respondent issued proceedings RC.No.10677/E4.B/2024 dated 27.08.2024 calling upon the 3rd Respondent to rectify and re-fix seniority of the Petitioner in the seniority lists dated 02.06.2018 and 24.06.2024.
3. As the Respondents are taking steps to effect promotions basing on the seniority list dated 24.06.2024, the Petitioner apprehending that her name will not be considered as her seniority was yet to be re-fixed, this writ petition is filed.

3. Heard Sri Sai Gangadhar Chamarthy, learned counsel for the Petitioner and Government Pleader for Services-I.

Learned counsel for the Petitioner would submit that it is sufficient if a direction is given to the 3rd Respondent to pass appropriate orders in terms of proceedings issued by the 2nd Respondent vide RC.No.10677/E4.B/2024 dated 27.08.2024.
5. Learned Assistant Government Pleader for Services did not refute the said submission.
6. Though the 2nd Respondent issued proceedings vide RC.No.10677/E4.B/2024 dated 27.08.2024 calling upon the 3rd Respondent to rectify the seniority list of Head Nurse and take necessary steps for issuing promotion to the Petitioner, so far the 3rd Respondent has not passed any orders.

In that view of the matter, the writ petition is disposed of, at the stage of admission itself, with the following directions: (i) The 3rd Respondent is directed to pass appropriate orders after examining proceedings issued by the 2nd Respondent dated 27.08.2024, if the Petitioner is entitled to as per Rules, within a period of four weeks from the date of receipt of a copy of this order before effecting promotions.
