1. Challenge in this petition is the order of transfer dated 26.06.2025 whereby the petitioner has been transferred from District Ayush Hospital Rajnandgaon to District Ayush Hospital Durg.

Learned counsel for the petitioner would submit that the petitioner has been transferred to Durg in place of respondent No.5 whereas the respondent No.5 has been transferred in place of petitioner. 2 representation to the transfer committee for their mutual transfer in place of each other and they agreed to be transferred mutually in their respective place as both of them have been transferred in place of each other, however, the said representation of the petitioner and respondent No.5 have not been considered till date and therefore the transfer committee may be directed to consider their representation within stipulated time period.

Learned counsel for the State opposes the submission, however, he would submit that the writ petition may be disposed of with an observation that the committee shall decide the pending representation within stipulated time frame in accordance with law.

Considering the submissions made by the counsel for the parties and also considering the issue involved, the transfer committee is directed to decide the pending representation of the petitioner dated 27.06.2025 within a further period of three weeks from the date of receipt of copy of this order in accordance with law on its own merit. The petitioner is
directed to produce a copy of this order within a week to the transfer committee. Till decision of the transfer committee, the parties shall maintain status quo as it exists today so far as transfer of petitioner vide order dated 26.06.2025 is concerned.
