1. The petitioners have filed the present writ petition claiming following reliefs: a. This Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus or suitable direction / directions / order /orders to the respondents to allow the petitioners Seniority & benefits of Notional Pay Fixation from the year, 2012 as granted to the respondent no. 04. b. This Hon'ble Court kindly be pleased to allow the consequential benefits of services etc. c. Any other relief as the Hon'ble Court may be deemed fit and proper. d. May kindly be pleased to allow the cost of petition.”

Learned counsel for the petitioners would submit that the petitioners have been appointed by the order dated 24.12.2024 and 19.03.2025 on the post of

3. Rural Health Organizer (Male) and posted at various health centres at Durg district. However, their pay scale has been fixed from the prevailing pay scale on the date of their appointments, whereas the other employees have been granted the benefit of pay scale from the date of appointment of other similarly situated candidates i.e. from the year 2012. She would further submits that the similarly situated employees have filed a WPS No. 2112/2012 and other batch of petitions in which there writ petition was allowed vide order dated 25.04.2023 by Coordinate Bench of this Court and the petitioners are also entitled for the same relief as has been granted in WPS No. 2112/2012. The petitioners have moved their representation on 20.05.2025 to the respondent No.3 but the same has not been considered till date in accordance with law, therefore, the respondent No.3 may be directed to take decision on their pending representation dated 20.05.2025 (Annexure P/8) within the stipulated time frame in view of the order passed by Coordinate Bench of this Court in WPS No. 2112/2012.
4. On the other hand, learned counsel for the State have no objection if such a direction is being made to the respondent No.3 to take a decision on their pending representation dated 20.05.2025 (Annexure- P/8) in accordance with law.

Considering the submissions made by learned counsel for the parties and limited grievance of the petitioners with respect to the decision on their pending representation, the respondent No.3 is directed to take a decision on the pending representation of the petitioners dated 20.05.2025 (Annexure P/8) within eight weeks from the date of receipt of copy of this order in accordance with law on its own merits keeping in view the order passed by Coordinate Bench of this Court dated 25.04.2023 passed in WPS No. 2112/2012 after verifying the service records of the petitioners and applicable rules and circulars.

6. The petitioners are directed to produce copy of this order to the respondent No.3 within two weeks from today.
7. With the aforesaid observation, the present writ petition is disposed of.
