The case of the petitioner, in brief, is as follows: The petitioner is the absolute owner and possessor of the agricultural land to an extent of Ac.1.50 cents in Sy.No.234-2 in Neelampeta village, Cheedikada Mandal, Anakapalli District, purchased under registered sale deed dated 18.07.2023 vide document No.2059 / 2023 at the Joint Sub-Registrar Office, Madugula. The vendor of the petitioner was in lawful possession. The vendor’s name was recorded in the revenue records, such as Adangal, IB register. The e-pass book was also issued by the respondent No.4 to the vendor of the petitioner. On purchase, the petitioner immediately took possession of the same and has been in peaceful possession and enjoyment of it since then. On 15.07.2025, without issuing prior notice, a. b.
3 W.P.No.24551 of 2025 the officials from the office of the respondent No.8 unlawfully entered the agricultural land of the petitioner and cut down the trees causing loss and mental distress.
Immediately, on 16.07.2025, the petitioner made a representation to the respondent No.4 complaining against the illegal acts. On 23.07.2025, the petitioner submitted a representation to the respondents Nos.6 and 8 against the illegal interference in the possession and the damage caused, while seeking appropriate action and protection. Then, the petitioner received notice dated 29.08.2025 from the respondent No.8 directing the petitioner to vacate the land, while calling for explanation regarding the occupation of the land. The petitioner submitted an explanation dated 01.09.2025 to the respondent No.8, under acknowledgement, stating the ownership and the possession. Even then, the forest officials are threatening the petitioner to forcefully evict him from the land. Hence, this writ petition is filed. severe Sri.B.Bhanu Raja,

Since the respondents admit possession of the petitioner in the disputed land by issuing notice, however contend that the said property is the then Valabu Reserve Land and was encroached; and the petitioner submitted the explanation, for which a speaking
order is required to be passed, till then, there shall not be any interference with the possession and enjoyment of the petitioner over the disputed land.

4 W.P.No.24551 of 2025 In the result, the writ petition is
disposed of directing the concerned respondents to pass a speaking order in response to the notice dated 29.08.2025 and reply dated 01.09.2025, and till such time, there shall not be any interference with the possession and enjoyment of the petitioner over the above said land. There shall be no order as to costs.
6. Pending miscellaneous applications, if any, shall stand closed.
