2025:UHC:2740 SL. No. Date Office Notes, reports, orders or proceedings or directions and Registrar’s
order with Signatures COURT’S OR JUDGE’S ORDERS
WPMS/676/2025 Hon’ble Rakesh Thapliyal, J.
1. Mr. Rishabh Bisht and Mr. B.S. Koranga,
learned counsel for the petitioner.
2. Mr. Ganesh Kandpal, learned Deputy Advocate General for the State.
3. By the instant writ petition, the petitioner is praying for the following relief:
“i. Issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 10.02.2025 passed by respondent. ii. Issue a writ, order or direction in the nature of mandamus commanding the respondent to issue a renewal certificate to the petitioner to practice as a notary advocate.”
4.
Learned counsel for the petitioner submits that petitioner was appointed as Notary Advocate and his application for renewal was rejected in a cursory manner without application of mind.
5. He further submits that one identical matter came up before Division Bench of this Court in Special Appeal No. 616 of 2019 decided 05.07.2019 and by referring this judgment, learned counsel for the petitioner submits that while rejecting the application of the petitioner for renewal of notary certificate reason has to be assigned but in the present case merely on the ground that new panel has been formed, application for renewal has been rejected. He further submits that impugned order is against the mandate of judgment dated 05.07.2019 passed by Division Bench of this Court.
6. On the other side, Mr. Ganesh Kandpal, learned Deputy Advocate General for the State has not disputed this fact that identical issue has been decided by the Division Bench of this Court in Special Appeal No. 616 of 2019 by judgment dated 05.07.2019.
7. Accordingly, present writ petition is
disposed of in terms of judgment dated 05.07.2019
2025:UHC:2740 rendered by the Division Bench of this Court in Special Appeal No. 616 of 2019 with a direction to the respondent to reconsider and decide the application of the petitioner for renewal of notary certificate by reasoned and speaking order after taking into consideration the past performance of the petitioner.
8. Writ petition is disposed of finally.
