Heard the parties.
The petitioner has been made accused in connection with Gidhour P.S. Case No. 34 of 2024 (S.T. No.288 of 2024), for the offences registered under Sections 376/341/323/506/504 of the I.P.C., pending in the Court of learned Additional Sessions Judge-II, Chatra.
Bail application of the petitioner was earlier rejected by this Court vide B.A. No.7387 of 2024 by order dated 28.10.2024.
On 05.05.2024, the petitioner is alleged to have raped the prosecutrix.
Learned counsel for the petitioner submitted that statement of the victim was recorded during the trial in which she has supported the prosecution case in her examination-in-chief, but in her cross-examination, she has not entirely supported the prosecution case. It was also submitted that earlier the informant had filed a case against the petitioner that he has assaulted her son and thereafter, this case has been filed again at the instance of her husband.
Considering the fact that the prosecutrix has supported the allegation in her examination-in-chief, it will not be proper to look into her cross- examination at this stage as it will have bearing on the fate of the trial.
In view of the aforesaid facts, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected.
From the deposition of the evidence of the prosecutrix recorded as P.W.-3, it appears that the learned trial court has stated the name of the prosecutrix in her deposition. It has time and again been impressed upon

the trial court that the identity of the victim of sexual assault cases should not be revealed. Learned Additional Sessions Judge-II, Chatra is directed to be careful in future.
