An order of punishment of withholding three annual increments with cumulative effect (for the years July, 2022, 2023 and 2024) was imposed upon the petitioner vide order dated 11.11.2022 against which the petitioner preferred his departmental appeal on 09.09.2024 which till date has not been decided. Therefore, learned counsel for the petitioner confines his prayer for a limited direction to respondent No.2 to decide his pending departmental appeal dated 09.09.2024 within stipulated time frame. 2 2. Learned counsel for the State does not have any objection if such a direction is given to respondent No.2 to decide pending department appeal of the petitioner within stipulated time period. 3. Taking into consideration the limited prayer made by the petitioner and also considering the fact that departmental appeal of the petitioner is pending since 09.09.2024, without entering into the merits of the case the respondent No.2 is directed to consider and decide the pending appeal of the petitioner in accordance with law on its own merits within a period of three months from the date of receipt of copy of this order after affording due opportunity of hearing to the parties concerned. The petitioner is directed to produce a copy of this order to respondent No.2 within two weeks from today. 4. With the aforesaid observations, the Writ Petition stands finally disposed of.
