Respondent(s) For Petitioner(s) : Mr. Vivek Kumar Agrawal, Advocate For Respondent(s) : Mr. Vinod Kumar Deshmukh, Advocate Hon’ble Shri Justice Sachin Singh Rajput 2 Order on Board 06/03/2025 This writ petition has been filed by the petitioner claiming following reliefs : 10.1 That, this Hon'ble Court may kindly be pleased call for the entire record relating to the petitioner's EER from the date of his appointment in SECL for kind perusal of this Hon'ble Court. 10.2 That this Hon'ble Court may kindly be pleased to direct the respondent authorities to review and upgrade the marks of EER by awarding Excellent rating pertaining to year 2011-12 in a proper manner after appreciating the work performed by the petitioner and looking to his past EERs in which he has been awarded more than 80% marks. 10.3 That, this Hon'ble Court may also kindly be directed the respondents to consider and decide the representations made by the petitioner against his transfer as well as direct the authorities to refund the deducted amount from the salary of the petitioner towards penal rent or grant HRA in favour of the petitioner from the date of joining the service in SECL, Korba. 10.4 Cost of the petition may also be granted in favour of the petitioner. 10.5 Any other relief which this Hon'ble Court may deem fit in the facts & circumstances of case. 2. Learned counsel for the petitioner submits that for the present, the grievances of the petitioner would be redressed if the respondent may be directed to decide the representation dated 25.10.2013 (Annexure P-14) made by the petitioner with regard to his grievances as projected in the writ petition. 3. Learned counsel for the respondents submits that the petitioner had earlier filed writ petitions which were disposed of with the direction to the respondent to decide the representation made by the petitioner which has already been decided by the respondents on 3 13.09.2013 (Annexure P-1), which is not under challenge. However, he fairly submits that the respondents would decide the representation of the petitioner (Annexure P-14) dated 25.10.2013 in accordance with law by a speaking order. 4. Be that as it may, in the light of the submissions made at the Bar, this Court feels it expedient to dispose of this writ petition with a directions to the respondents / competent authority to decide the representation made by the petitioner Annexure P-14 dated 25.10.2013 in accordance with law within the period of 120 days from the date of receipt of copy of this order by a speaking order and communicate the same to the petitioner.
