Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioner has prayed for the following reliefs:- (I) “That the auction notice contained in Annexure P-3 may kindly be quashed and set aside as the same has been passed in violation of Section 18 of the Recovery of Debts Due to Banks and Financial Institutions Act, 1993. (II) That the respondents may be directed to restrict the loan and adjust the amount of Rs.9,00,000/- towards loan account.” 2 2. Learned counsel for the respondents has apprised the Court that the petitioner has concealed material facts from this Court including the factum of his having approached the Additional Registrar (Mon.) Cooperative Societies H.P., by way of an application filed under Section 27(3) of the Himachal Pradesh Cooperative (Agriculture and Rural) Development Bank, Act, 1979, wherein indulgence was shown to the petitioner, who thereafter also failed to do liquidate the liability which has led to the passing of the impugned order. A perusal of the petition demonstrates that all these facts are conspicuously concealed from the Court by the petitioner. 3. Faced with this situation, learned Senior Counsel for the petitioner submits that the petitioner be permitted to withdraw this petition. 4.
