The appellant has filed the instant appeal under Section 374(2) of the Code of Criminal Procedure, 1973, (hence forth ‘the SHOAIB ANWAR Digitally signed by SHOAIB ANWAR Date: 2025.09.09 17:24:46 +0530 2 Cr.P.C.’) questioning the judgment of conviction and order of sentence dated 17.12.2015 passed by the learned Special Judge (SC/ST) Act Korba, Chhattisgarh in Special Sessions Trial No. 09/2014, arisng out of Criminal Case No. 167/2014 committed on 26.03.2014 by the Learned C.J.M., whereby the appellant has been convicted under Section 354 of IPC and Under Section 3(1)(xi) of SC and ST (Prevention of Atrocities) Act, 1989 and sentenced to undergo R.I. for 1 year and fine of Rs. 1,000/- with usual default stipulation and R.I. for 1 year and fine of Rs. 1,000/- with usual default stipulation. 3. Learned counsel for the State has placed a copy of death certificate of the appellant before this Court and informed that the appellant namely Santosh Das Mahant died on 25.04.2021. The said Death certificate has been issued by the Grama Panchayat, Rajagamar, and the same is taken on record. 4. In view of the above, the present appeal is dismissed as abated.
