Vijay Kanwar W/o Balwant Singh, R/o Rawatbhata Road, Opposite Chavi Vidyalay, Shyam Nagar, Kota (Raj.). ----Respondents For Petitioner(s) : Mr. Ashvin Garg For Respondent(s) : Mr. N.S. Dhakar, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 06/01/2025 Heard. By way of this application under Section 483(3) of BNSS., the petitioners-complainant has approached this Court seeking cancellation of anticipatory bail granted to the respondent Nos.2 & 3 by order dated 02.07.2024 passed by learned Sessions Judge, Kota in Criminal Misc. Case No.1418/2024. Having heard and considered the submissions advanced at bar and after going through the order under challenge as well as the FIR, I am of the firm opinion that the impugned order does not suffer from any infirmity whatsoever so as to call for interference [2025:RJ-JP:514] (2 of 2) [CRLBC-159/2024] therein. Looking to the nature of offence; allegations attributed to the accused respondents, arising out of a transaction of house, situated in front of Chhavi School, Shyam Nagar, Rawatbhata, Kota as well as absence of any previous criminal antecedents, the learned trial court extended facility of anticipatory bail to them. Thus, the instant bail cancellation application is dismissed as being devoid of merit. However, henceforth, the accused-respondents are directed to join and cooperate in investigation. In case, the accused respondents fails to join investigation and comply with the conditions of bail order dated 02.07.2024, the petitioner would be free to to approach the court concerned for cancellation of bail.
