ORDER: The instant petition under Section 482 of the Code of Criminal Procedure, 1973 (in short, “Cr.P.C.”) has been filed by the Petitioner/ Accused No. 1, seeking quashment of the proceedings pending against him in CC.No.304 of 2022 on the file of Court of Judicial First Class Magistrate, Kaikaluru. Heard Sri T.V.V.Koteswara Rao, learned Counsel for the petitioners and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State. Notice which was sent to the respondent No.2 is returned unserved.

Learned counsel for the petitioner would submit that the petition may be
disposed of without causing any prejudice to the rights and contentions of the petitioner, by dispensing the presence of the petitioner/AI before the Trial Court.
4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. Considering the submissions made, the Criminal petition is disposed of without causing any prejudice to the rights and contentions of the petitioner. However, the presence of the petitioner/A1 before the Trial Court is dispensed with unless his presence is specifically directed by the Trial Court. However,

T 3 the petitioner is at liberty to raise all the contentions before the Trial Court in his defence. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
