Mr. Rishabh Bisht, learned counsel holding the brief of Mr. V.K. Guglani, learned counsel for the applicant. 2. Mr. Sandeep Sharma, learned A.G.A. for the State. 3. Present applicant Avnish Kumar Chopra is languishing in jail since 07.12.2024 in relation to FIR dated 06.12.2024 bearing FIR No. 188 of 2024 wherein the present applicant has been implicated for the offences punishable under Section 316(4), 336(3), 338, 340(2) of BNS 2023. 4. Learned counsel for the applicant submits that the applicant is innocent and furthermore there is no independent witness of the alleged crime and there is seven days delay in lodging the FIR but there is no explanation to this, and furthermore, applicant has no previous criminal history. He further submits that charge sheet has already been filed therefore there is no need of custodial interrogation of the present applicant. 5. On the other side, learned counsel for the State has not disputed this fact that charge sheet has already been filed and there is no need of custodial interrogation of the applicant. 6. After hearing the learned counsel for the parties this Court is of the view that since charge sheet has already been filed and as such there is no need of custodial interrogation of the applicant, hence, the applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merits of the case the bail 2025:UHC:3082 application is allowed. 8. Let the applicant Avnish Kumar Chopra be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
