The petitioner is apprehending his arrest in connection with in connection with Rajpur P.S. Case no. 43 of 2021, pending in the court of Learned Judicial Magistrate-1st Class, Chatra, for offences under sections 272, 273, 34 of the Indian Penal Code and Section 47(a) of Excise Act. 3. Learned counsel appearing for the petitioner submits that in one Scorpio vehicle, foreign liquor was being carried, which has been seized and the name of the petitioner has come in the confessional statement of the apprehended co-accused. He next submits that the petitioner has got no criminal antecedent as disclosed in 10 of the petition. He further submits that one identical situation co-accused person has been granted anticipatory bail in ABA No.5479 of 2023. 4. Learned counsel appearing for the State opposed the prayer and submits that the name of the petitioner has come in the confessional statement of the apprehended co-accused. 5. Considering that the name of the petitioner has come in the 2025:JHHC:38023 2 confessional statement of the apprehended co-accused the petitioner has got no criminal antecedent as disclosed in Para 10 of the petition and one identically co-accused person has been granted anticipatory bail in aforesaid ABA, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner above named is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate-1st Class, Chatra, in connection with Rajpur P.S. Case no. 43 of 2021, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. 7.
