HON'BLE MR. JUSTICE MANEESH SHARMA Order 23/04/2025 Heard learned counsel for the appellants.
[2025:RJ-JP:17188] (2 of 2) [CMAP-248/2018] The present miscellaneous application has been filed by the claimants with a limited prayer that the record of the Court below relating to Claim Case No.327/2007(54/2006) be remitted to the learned Court below in order to decide the case pursuant to the remand order dated 08.12.2014 passed by this Court. A bare perusal to the record of the case reveals that the record of the Court below was not summoned, either in SBCMA No.3539/2012 or in another appeal bearing No.1237/2011. Therefore, no direction to remit the record can be passed in the present application. It is also evident from the order-sheet dated 10.12.2018 that record of the Court below was summoned in SBCMA No.2772/2010 and the same was ordered to be sent back to the learned Trial Court. Thus, the prayer made in the application does not survives. However, if some grievances still left with the claimant, regarding the non-availability of the record, they are free to move appropriate application in this regard. The application stands disposed of.
