Petitioner has been made accused in connection with S.T. No. 138 of 2019 arising out of Barhait P.S. Case No. 29 of 2018 for the offences registered under Sections 304-B of the Indian Penal Code and charge has been framed for the offences under Sections 302, 174-A of the Indian Penal Code, pending in the Court of learned Additional Sessions Judge-III, Sahebganj. 3. The petitioner happens to be the husband of deceased Sandhya Devi, who was immolated in her matrimonial home to enforce the demand of dowry. 4. It was submitted that there is no eyewitness to the occurrence. It was further submitted that the petitioner was not present at the place of occurrence at the time of occurrence. 5. Form perusal of the case diary, it appears that the independent witnesses have supported the fact that the petitioner used to assault the deceased and asked her to bring something or other from her parental house. They have also stated that the petitioner had immolated the deceased. 6. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is rejected. 7. Learned Trial Court shall expedite the trial. (Ambuj Nath, J.) R.Kr. 04.11.2025
