ORDER:-
Heard the learned counsel for the petitioner.
2. The petitioner is challenging the registration of C.C.No.2821 of 2019 against the petitioner for the alleged offences under sections 326 and 506 of the IPC.
3. The learned counsel for the petitioner submits that initially, the petitioner was tried for an offence under Section 326 of the IPC. Subsequently, the provisions of law were altered from Section 324 to Section 326 of the IPC. It is submitted that the petitioner and the 2ndrespondent are relatives and there was a family dispute between them. It is further submitted that following a minor altercation, the 2ndrespondent filed a complaint. It is also submitted that the Medical Officer's statement and opinion are based on the information provided by the Radiologist, and the Radiologist has not been arrayed as a listed witness by the investigating officer while filing the charge sheet.
4. Perused the wound certificate. It appears that the doctor who treated the 2ndrespondent had opined that the injury is grievous in nature, and such opinion is based on the Radiologist's opinion. It is not known whether the Radiologist has submitted a report along with the X-ray of the injured hand. It is submitted by the learned counsel for the petitioner that the matter is posted before the trial court for issuance of summons to the witnesses.
5. Considering that the case is of the year 2019, this Court without going into the merits of the matter and without opining on merits of this case

disposed off the criminal petition, leaving it open for the petitioner to take all grounds as raised in the criminal petition before the learned Magistrate for the purpose of trial.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
