O R D E R:
This writ petition under Article 226 of the Constitution of India is filed for the following relief:
“…to issue appropriate writ or order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents 2 and 3 in calling the petitioner to the 3rd respondent police station and threatening to withdraw the proceedings against the 4th respondent initiated in respect of the land in Sy.No.180 an extent of Ac.5.02 cents of Padamati Yaleru Village of Athmakur Mandal, Anantapur District is illegal, arbitrary, without jurisdiction and in violation of Principles of Natural justice and in violation of Art.14 and 21 of the Constitution of India and consequently direct the respondent No.3 not to call the petitioner to the police station in connection with the Civil dispute relating to the land in Sy.No.180 an extent of Ac.5.02 cents of Padamati Yaleru Village of Athmakur Mandal, Anantapur District in the interest of justice and to pass......”
2. Heard Sri Sreemannarayana Vattikuti, learned counsel for the petitioner and learned Additional Government Pleader for Home. 4
3. The contention of the petitioner is that the police without registering any case, calling the petitioner to the Police Station and harassing him. 4. Learned Additional Government Pleader for Home on instructions would submit that police never calling the petitioner to the Police Station, as alleged in the petitioner’s affidavit. 5. Undisputedly, this matter was filed in the year 2018.
Therefore, at this length of time, this Court is of the considered opinion that no further orders are required in the petition, and it can be disposed of without going into the merits of the case, with an observation that police shall follow due procedure established by law, if they intend to call the petitioner to the Police Station in connection with the enquiry/investigation of any case. 6. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
