Mr. Chander Shekhar Thakur, Advocate, for the applicants/respondents. The present applications under Order 1, Rule 10, read with order 22, Rule 9 of CPC and Section 5 of the Limitation Act have been filed by the applicants for impleading them as party in the present appeal. As per the applicants, respondent No. 1, Parkash Chand, has expired on 01.02.2020 and left behind them as his legal heirs. However, delay in filing the application has occurred as the main case remained unlisted since May, 2018 and it was only in the second week of July, 2025 that the applicants inquired about the case status and informed the counsel about the death of respondent No. 1. Therefore, the delay, as occurred, is neither intentional nor willful, but was beyond the control of the applicants, as such, the same deserves to be condoned. The applications are duly supported with the affidavit of applicant Sanjay Kumar, death certificate of the deceased and legal heirs certificate. Having regard to the averments made in the applications, the same are allowed and the applicants, as mentioned in para-3 of the application (CMP No. 30525/2025) are impleaded as party respondents in the present appeal, being legal representatives of deceased respondent No. 1, Parkash Chand and shall figure as party respondent No. 1(a) to 1(d) in the array of respondents.
